Distinguish pardon granted by the offended party and pardon granted by the President

1. Pardon by the offended party applies only to crimes against chastity and rape while pardon by the Chief Executive applies to any crime.

2. Pardon by the offended party in seduction, abduction, or acts of lasciviousness benefits the co-principals, accessories and accomplices. In adultery and concubinage, the pardon must be extended to both offenders. Pardon by the Chief Executive can be granted to any or all of the accused.

3. Pardon by the offended party cannot be made subject to a condition while pardon by the Chief Executive may be absolute or conditional. (Abelardo C. Estrada, Criminal Law: Made Easy for Students, Bar Examinees & Practitioners)
